1. OurCauldron.com (the “Site”) is a public access portfolio hosting web site and community. Cauldron Living, Inc.. (the “Owner”) is the owner of the Site. Neither the Site nor the Owner owns or claims to own any personal portfolio content or images uploaded by individual users for individual promotion and presentation. The user agrees to abide by this Agreement and Site guidelines.

2. OurCauldron.com offers certain hosting and e-mail services at no cost to members, and at a nominal cost to others.

3. Disclaimer: The Site contains information, images, facts and opinions from various individuals and/or organizations. THE CONTENT ON THE SITE AND THE SERVICES ASSOCIATED WITH THE SITE ARE PROVIDED ON AN “AS IS” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF TITLE OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OTHER THAN THOSE WARRANTIES WHICH ARE IMPOSED BY, AND INCAPABLE OF EXCLUSION, RESTRICTION OR MODIFICATION UNDER THE LAWS APPLICABLE TO THIS AGREEMENT. NOR ITS SHAREHOLDERS, PRINCIPALS, EMPLOYEES, AGENTS, REPRESENTATIVES, ASSIGNEES AND/OR AFFILIATES ENDORSE OR ARE RESPONSIBLE FOR THE ACCURACY OR RELIABILITY OF ANY OPINION, ADVICE, STATEMENT, INFORMATION OR OTHER CONTENT ON OURCAULDRON.COM.

4. The Site has bulletin boards and chat rooms which allow you and other users to post information, provide feedback to the Site, and interact in real-time. You agree not to post or transmit any unlawful, fake, fraudulent, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, profane, hateful, racially, ethnically or otherwise objectionable material of any kind, including, but not limited to, any material which encourages conduct that would constitute a criminal offense, violate the rights of others, or otherwise violate any applicable local, state, national or international law. In addition, you agree not to post information or other content that is not of a professional nature or which contravenes United States and/or international trademark or copyright laws and restrictions in any way. You will be responsible for, and indemnify and hold harmless Cauldron Living, Inc.., its shareholders, principals, employees, agents, representatives, assignees and/or affiliates against any claim arising from any material that you put on the Site or transmit. Although Cauldron Living, Inc. and its representatives may from time to time monitor or review discussions, chats, postings, transmissions, bulletin boards, and other content on the Site, neither Cauldron Living, Inc.. nor its representatives are under any obligation to do so. Cauldron Living, Inc.. reserves the right to change or modify portfolio information or message board postings as it decides is needed and without notice. You acknowledge that Cauldron Living, Inc., and its representatives are not responsible for the information available on the bulletin boards, chat rooms and portfolios and that any opinions, advice, statements, services, offers or other information or content presented or disseminated on any bulletin board, chat room or portfolio are those of their respective authors who are solely liable for their content. Cauldron Living, Inc. and its representatives reserve the right, in their sole discretion, to edit, refuse to post, or remove any material, links, email addresses, images, and content submitted to, or posted on the chat rooms, bulletin boards, or portfolios. Cauldron Living, Inc. and its representatives reserve the right in their sole discretion to deny access to the email systems. The Site has guidelines regarding posting of appropriate images, email addresses, content, and links. You agree to adhere to the guidelines as posted throughout the Site.

5. Your use of the Site is at you own risk. NEITHER CAULDRON LIVING, INC. NOR ITS SHAREHOLDERS, PRINCIPALS, EMPLOYEES, AGENTS, REPRESENTATIVES, ASSIGNEES AND/OR AFFILIATES SHALL BE LIABLE TO YOU OR ANYONE ELSE FOR ANY LOSS OR INJURY OR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE OR SIMILAR DAMAGES ARISING OUT OF YOUR ACCESS OR USE OF, OR YOUR INABILITY TO ACCESS OR USE, THE SITE AND THE INFORMATION AND/OR CONTENT AVAILABLE ON THE SITE OR ARISING OUT OF ANY ACTION TAKEN IN RESPONSE TO OR AS A RESULT OF ANY INFORMATION AVAILABLE ON THE SITE. YOU HEREBY WAIVE ANY AND ALL CLAIMS AGAINST OurCauldron.com, CAULDRON LIVING, INC. AND ITS SHAREHOLDERS, PRINCIPALS, EMPLOYEES, AGENTS, REPRESENTATIVES, ASSIGNEES, AND/OR AFFILIATES ARISING OUT OF YOUR USE OF THE SITE AND THE INFORMATION AND CONTENT AVAILABLE THEREON.

6. Any communition or material you post or transmit to the Site is, and will be treated as non-confidential and non-proprietary. You assume full responsibility for anything you post or transmit, and you grant Cauldron Living, Inc.. and its representatives the right to edit, copy, publish and distribute any information or content you post or transmit for any purpose.

7. Our Cauldron and its representatives do not review or monitor any web sites linked to the Site from personal portfolios on the Site. When clinking links to other web sites all users of the Site acknowledge that the Site and Owner are not responsible for the accuracy or content of those links and sites. You agree to not post URLs and other web links in any form into the content that you post to the Site, whether in your portfolio or elsewhere, that lead to ADULT SITES or Pay Sites. Cauldron Living, Inc.. reserves the right to remove from the Site any references or portfolios containing Adult Sites or Pay Sites without notice. Additionally, certain links to sites, as determined from time to time by Our Cauldron, or the use of links and web addresses, or the use of html formatting And scripting in certain portfolio types as determined by Our Cauldron, Inc., may Not be permitted within the portfolio or as an acceptable use of the personal home page link or as portfolio content. Cauldron Living, Inc.. is under no obligation to allow the Site to provide exposure to competing sites through links or other methods in portfolios and remove those in its discretion, and without notice. The OurCauldron.com referral system is intended for work related offers and general inquiries related to or leading to work or further information. Promotion of services and goods is not an appropriate use of the referral system.

8. The promotion and recruitment of Escorts, Escort Services, Personal Companions, etc. is contrary to the purposes of the Site, and will not be tolerated in any fashion. Soliciting for, recruiting, or offering the services of escorts on the Site is strictly Forbidden. Portfolios that are used for the solicitation or promotion of escort services in ANY way will be immediately disabled with no refund or notice. This includes, without limitation, use of the referral system, hyperlinks to external sites promoting escorts, URLs (web addresses) promoting escorts and any other activity that Cauldron Living, Inc.. and its representatives deems as solicitations, promotions, or offers.

9. It is the stated policy of the Site that sexually explicit images are not permitted on the Site. Sexually explicit images include but are not limited to images of sexual intercourse, obvious states of sexual arousal (erections), or overt sexual positions (such as noticeably visable or spread genitalia). Failure to adhere to this restriction will result in the removal of the images, and the disablement of the member portfolio. Consistent misclassification (rating) or categorization or images may result in the forced setting of ratings and in gross violations may result in the removal of your portfolio.

10. Our Cauldron does not condone bandwidth theft, the linking of images from the Site to other sites, or the misuse of links from other sites to the Site. Anyone found linking images from the Site to other sites, copying content from the Site, or Cauldron Living, Inc.. determines is inappropriately linking to the Site will result in permanent removal from the Site without notice and may cause the notification of the appropriate state and/or federal authorities.

11. You should be aware that if you voluntarily disclose personal information in your portfolio, on a bulletin or in a chat room, that information can be used by others and may result in solicitations and/or other contacts from other parties and shall be the sole responsibility and liability of the poster and/or transmitter.

12. As a member of the Site, you will be contacted by other members of the Site to work with you, and you will receive occasional email from the Site. As new features or member programs and promotions are developed and launched, you will be informed via postings to the Site and/or email. When email is sent by the Site and returned with an email bad address, we will attempt to locate a correct address from any linked web site, and failing that we may disable your portfolio. However, If you discover you portfolio has been disabled because of bad contact information, please contact the Site with the correct information and the Site will re-activate your portfolio.

13. You agree that this User Agreement and any disputes arising out of or related to the User Agreement, the Site and/or the Owner shall be governed by, and construed and enforced in accordance with the laws of the State of California, and the courts located in Los Angeles, shall have exclusive jurisdiction. By your usage of, or posting to the Site constitutes your agreement to the conditions listed in this Agreement.

14. If you are under18 years old, a parent or legal guardian’s permission will be necessary to submit a portfolio or any personal information. If you are a parent or legal guardian of a personl younger than 18 years old, you must agree to this Agreement on behalf of your self and the minor, and ensure that you enter and approve all information, and that your email address and contact information is used at all times.

15. OurCauldron.com and Cauldron Living, Inc.. reserve the right to change and modify these usage rules as they deem appropriate and without notice.

16. Violation of these Terms and Conditions will cause your membership to be terminated without notice.
